Acceptance of a quote or statement of work by you (including by email or electronic confirmation) constitutes acceptance of the terms set out therein. The formation and performance of such contracts are subject to the laws of Hong Kong, including the requirements of offer, acceptance, consideration, and intention to create legal relations.

6. Intellectual Property

Unless otherwise agreed in writing, all intellectual property rights in materials we create in the course of providing Services (including code, designs, and documentation) remain ours until full payment has been received. Upon full payment, we will grant you the rights agreed in the relevant project agreement. Content on the Website (including text, graphics, logos, and layout) is owned by the Company or our licensors and may not be copied or used without our prior written consent.

7. Limitation of Liability

To the fullest extent permitted by Hong Kong law, we shall not be liable for any indirect, incidental, special, or consequential loss or damage arising from your use of the Website or our Services. Our total liability in respect of any claim or series of related claims arising from or in connection with a single project or these Terms shall not exceed the total fees paid or payable by you to us in respect of that project in the twelve (12) months preceding the event giving rise to the claim. Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded or limited under Hong Kong law.

8. Confidentiality

Each party shall keep confidential any information disclosed by the other that is marked confidential or that reasonably ought to be treated as confidential, and shall use it only for the purpose of performing or receiving the Services. This obligation survives termination of the relevant agreement. Disclosure may be made where required by law or with the other party's prior written consent.

9. Privacy

Your use of the Website and our Services is also governed by our Privacy Policy, which explains how we collect, use, and protect personal data in accordance with the Personal Data (Privacy) Ordinance (Cap. 486) of Hong Kong.

For existing contracts, the Terms in effect at the time of contract formation continue to apply to that contract unless otherwise agreed.
